Data Collected and Processed

Through its website, Next Generation collects information (that does not allow the identification of a given natural person) similar to information which browsers and servers usually provide, such as browser type, language preference, referring site, dates and times of each visit, etc.

The purpose pursued by Next Generation when collecting this type of information is to better understand visitors' use of its website. In this case, the scope and typology of the data collected by Next Generation depends on the nature of the interaction initiated by the visitor. In case of interaction, you will only be asked to provide the personal and financial information strictly necessary for the proper functioning of said services.

Notwithstanding the foregoing, the visitors interacting with Next Generation may voluntarily not provide additional data, provided that in such a case, their e-transfers or claims cannot then be properly processed by us.

Through its online services, Next Generation collects information allowing your authentication as a legitimate user of its online services, in order to allow you to perform e-transfers in a secure manner. In this perspective, Next Generation can diffuse information (allowing the identification of a given user) in the form of aggregated information, for the needs of the treatment of an e-transfer or for information on possible technical incidents or to comply with the AML-CFT provisions. However, the user’s authentication elements provided when using our online services remain under the effective control of our team responsible for ensuring the conformity of operations, always with the aim of ensuring security and responsiveness in the event of any incident or problem reported by a user or to prevent fraud and abuse by third parties.

Next Generation may also receive your personal data indirectly during a visit to our website or use of our online services via cookies in your browser (see our Cookie Policy) and/or indirectly from the following sources: Google, LinkedIn, Twitter and other social networks.

Next Generation stores personal data in databases that comply with legal requirements. In addition, Next Generation may also store information to manage its service offerings, including in its relationships with you, and to conduct internal studies or design marketing campaigns.

With the exception of highly confidential data strictly necessary for the processing of your e-transfers (such as bank details or wallet addresses), Next Generation does not intentionally collect or retain other sensitive and/or highly confidential personal data, such as information relating to your gender, ethnic origin, political opinion, religious belief, state of health, or any other sensitive information, and does not in any way want its visitors or users to provide it with this type of information.

If such information should ever reach us, because you decide to share it with us despite the above, Next Generation cannot be held responsible and you will be deemed to have voluntarily accepted that we may, against our will, process your sensitive and/or highly confidential data. Consequently, you may not claim against us that we have not complied with the French and European legislation in force applicable to the processing of sensitive or financial data.

Use of Data

Next Generation uses visitors’ personal data primarily to better understand their interests when visiting our website and also how it is accessed, as well as to better analyze our users' needs and expectations when they use our online services.

Next Generation also uses such personal data to communicate with visitors in case of interaction to enable the completion of their e-transfer requests, to monitor compliance processes, to respond to specific requests (e.g., claims, technical assistance, etc.), etc.

In addition, Next Generation may use personal data to implement and maintain risk prevention measures that fall within the scope of the AML-CFT provisions or security, anti-piracy and anti-misappropriation measures for personal data.

Finally, to the extent permitted by law, Next Generation may from time to time use visitors’ personal data for marketing purposes, to better personalize our communication campaigns, to provide specific documentation, etc.

In any case, Next Generation will only useyour personal data for the purposes for which you have been informed, transmit it to its internal departments directly concerned by your interactions, and processes it in accordance with the provisions of French and European legislation (in particular those of French Law No. 78-17, known as the 'Informatique et Libertés' law and European Union Regulation No. 2016/679, known as 'GDPR'). Data Sharing

After having previously notified you and obtained your express consent or having allowed you to express your opposition to the proposed purposes, Next Generation may possibly transmit your data to external partners (such as our correspondent paying institutions located abroad or technical service providers) and/or commercial partners in the course of its business and/or in order to improve and/or secure access to its solutions and services. In such a case, these partners will have to comply with strict obligations regarding the processing of personal data, compliance with this privacy policy, with French and European legislation applicable in this area and with the clauses relating to confidential information contained in the agreements entered into by Next Generation with these partners.

In the event of a legal request in connection with investigations, court orders and/or legal proceedings, or as otherwise required by law, Next Generation reserves the right to share any information about you, including your personal data, as necessary to properly respond to such a legal request.

Social networks improve the user-friendliness of our website and help to promote it through sharing.

When you click on these icons, Next Generation could have access to personal information that you have designated as public and accessible from your Twitter and LinkedIn profiles. However, we do not create or use any database independent of Twitter or LinkedIn from the personal information you may post, nor do we use any of your personal information in this way.

If you do not want Next Generation to have access to the personal information published in the public area of your profiles or social accounts, then you should use the means made available by the said social networks (Twitter, LinkedIn or other) to limit access to your such data.

Data Protection

Next Generation implements all technical and operational measures to ensure the security, confidentiality and processing of your personal data and, in particular, takes all necessary precautions to prevent it from being altered, deleted or accessed by unauthorized third parties.

In the event of an incident affecting your data, Next Generation undertakes to comply with the obligation to notify violations of personal data, including to the National Commission for Data Protection and Liberties (CNIL-France).

Data Retention

Next Generation retains personal data relating to visitors to its website only as long as necessary for the purposes set forth above, which may not exceed one year. No data is retained beyond the scope from which it was first received. Beyond this period, the data collected will be either deleted or made anonymous.

Concerning its online services, Next Generation retains the personal data of its users for up to five years after the end of the commercial relationship between Next Generation and such users, as this data is archived for evidentiary purposes, in accordance with the French provisions in force, particularly those of the French Commercial Code. We only access personal data internally on a need-to-know basis, and we’ll only access or process it if absolutely necessary. At the end of this period, this data will either be deleted or made anonymous.

Your Rights Concerning Personal Data

In accordance with French and European legislation (in particular French law no. 78-17 'Informatique et Libertés' and EU regulation no. 2016/679 'GDPR'), you have the right to exercise the following rights with Next Generation at any time:

Right of Access (article 15, GDPR): you have the right to request from Next Generation a copy of the personal data we hold about you, it being specified, however, that a reasonable fee may be charged for this communication.

Right of Withdrawal (article 13-2c, GDPR): You have the right to withdraw your consent to Next Generation at any time.

Right of Rectification (article 16, GDPR): you have the right to ask Next Generation to update or correct any information that you consider inaccurate or incomplete.

Right of Opposition (article 21, GDPR): you have the right to ask Next Generation that your personal data no longer be processed.

Right of Deletion (article 17, GDPR): You have the right to request that Next Generation delete your personal data if it is inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication, or retention is prohibited.

Right to Limitation (article 18, GDPR): You have the right to request that Next Generation suspend the processing of your personal data.

Right to Portability (article 20, GDPR): you have the right to request that Next Generation retrieve your personal data, in order to dispose of it freely, when your data is subject to automated processing based on your consent or on a contract.

In accordance with the article 12 of the GDPR, Next Generation will have a period of one month from receipt to respond to any request from you relating to the exercise of one or more of the rights mentioned above, it being specified that this period may be extended by two months if the requests are complex and numerous.

All requests must be accompanied by proof of identity and be sent to the attention of the Data Protection Officer, either by e-mail (support@ngpes.com) or by post (Next Generation, att’n DPO, 35, avenue de Friedland, Paris, France).

If you are not satisfied with Next Generation’s response to your request or if you wish to file a complaint, you also have the legal right to contact the National Commission for Data Protection and Liberties - CNIL (https://www.cnil.fr), which is the competent national authority in France for data protection control.

Revisions to Our Privacy Policy

Although changes may be minor, Next Generation reserves the right to revise its Privacy Policy at any time, with any changes taking effect immediately upon posting, unless expressly stated otherwise.

Since such changes occur at its sole discretion and are published in real time, Next Generation therefore encourages visitors to its website as well as its users using its online services, to periodically review this page for any changes to its Privacy Policy.
